1. Acceptance of Terms

Welcome to makiw™ (the “Project”). The website and related services (the “Service”) are operated by Tomarange SL. By accessing or using the Service, you agree to these Terms of Use. If you do not agree, please do not use the Service.

These Terms of Use apply to all visitors, users, and others who access or use our Service.

2. Use of Our Service

You agree to use our Service only for purposes that are permitted by these Terms and any applicable law, regulation, or generally accepted practices in the relevant jurisdictions.

You may not engage in any of the following prohibited activities:

• Copying, distributing, or disclosing any part of the Service.

• Using any automated system, including "robots," "spiders," or "offline readers" to access the Service.

• Transmitting spam, chain letters, or other unsolicited email.

• Attempting to interfere with or compromise the system integrity or security.

• Using the Service in any manner that could disable, overburden, damage, or impair the site.

• Submitting prompts or uploading content that is unlawful, harmful, or infringes intellectual property rights (including third‑party logos/brands), or attempting to manipulate system behavior (prompt injection).

3. Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of these Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Platform Role and Payments

Tomarange SL operates the makiw™ online platform, connecting users with independent production partners that manufacture products based on submitted designs.

Payments are processed through Stripe. We do not store full payment card details.

4A. Cancellations and Refunds

Customers may cancel an order within two (2) hours after the order is placed. After this window, cancellation may no longer be possible because production may have started.

Refunds may be issued for individual order items when products are unavailable, defective, or otherwise eligible under the platform refund policy.

5. Products and Third-Party Brands

The Service may display example products, templates, or third‑party brand references as part of the Project. Any such references are used for demonstration, compatibility, or descriptive purposes only.

All third‑party names, logos, and product designs remain the property of their respective owners. Use of the Service does not imply endorsement, sponsorship, or affiliation with any third party.

You must not submit prompts or upload content that infringes third‑party rights (including trademarks, copyrighted works, or brand logos) unless you have permission to do so.

6. AI Features and User Content

The Service includes AI-assisted features that may generate text and images based on your inputs (including prompts and uploaded images). AI outputs may be inaccurate, incomplete, or unsuitable. You are responsible for reviewing outputs before relying on them.

You retain rights to your own input content. By submitting content, you grant the Project a limited license to process, store, and display your inputs and generated outputs for the purpose of operating, improving, and evaluating the Service.

Do not upload sensitive personal information. Do not upload content you do not have the right to use.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Tomarange SL (makiw™) and its licensors. The Service is protected by copyright, trademark, and other laws.

“makiw™” and related names and logos are used as identifiers of the Project. All rights reserved. You may not use the Project’s branding in a way that suggests endorsement or affiliation without prior written permission.

Unauthorized use of our trademarks, content, or intellectual property is strictly prohibited and may violate trademark, copyright, and other laws.

You are responsible for ensuring that any designs you submit or generate do not infringe third-party rights. Tomarange SL does not guarantee that user-submitted or AI-generated designs are free from third-party intellectual property claims.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

9. Limitation of Liability

In no event shall Tomarange SL, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

10. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
